TERMS OF SERVICE
At Renew Physiotherapy & Pilates Sdn Bhd (1516070-K) ("Renew Physiotherapy & Pilates", "the Studio", "the Company"), we have adopted these Terms and Conditions to provide for the safe and comfortable use of the Studio's premises.
These Terms and Conditions apply to your conduct within the Studio's premises, facilities and studio space, and to your conduct during classes, programs, training, workshops, events and/or other activities held off the premises involving the Studio.
The following Terms & Conditions govern the rights and obligations of Renew Physiotherapy & Pilates and its users.
1. Class Reservation
Private classes
Please contact the Studio to arrange a time slot with one of our instructors. Class reservations will be confirmed after the arrangement is made and after purchase of a package.
Group classes
To be made on our booking system, with prior purchase of a package.
2. Duration of Classes
All classes run for 50 minutes.
There is NO extension of the duration of your class if you arrive late. For example, if a class is scheduled for 10:00am and you arrive at 10:10am, the class will still end 50 minutes from the scheduled start time, i.e. 10:50am.
3. Arriving for Classes / Late Arrivals / No-Shows
We recommend arriving at least 15 minutes before class begins, to give yourself ample time to settle in.
We understand that circumstances arise and being late cannot always be avoided. We therefore allow a lenient 10-minute window for late arrivals to a group class. We apologise in advance for not allowing entries beyond the 10-minute mark, as it would be unsafe to join without a warm-up.
Your credit will not be refunded if you arrive late and do not attend, or if you do not show up.
Please inform the Studio if you know you will be arriving late or cannot make it for a class. We endeavour to be as considerate as possible to your circumstances.
4. Package Validity
All packages sold are non-refundable and non-transferable.
In extraordinary situations, transfer of packages is subject to the Studio's discretion.
All packages have a stipulated validity period, which begins from the date of the first appointment. Please write in to us if you require an extension; extensions are subject to the Studio's discretion.
5. Cancellation and Refund Policy
By you
You may cancel a booking up to 12 hours before the class and receive a refund of your credit. If you cancel with less than 12 hours' notice, the credit will be forfeited/deducted.
By the Studio
The Studio reserves the right to cancel a class in the event of any circumstances, without explanation required. Nevertheless, the Studio will endeavour to give sufficient notice of any cancellation. If the Studio cancels a class, your credit will be refunded.
How to cancel classes
● Group classes: You may cancel on our booking platform under the "Reservations" tab.
● Private classes: Please inform your instructor if you are unable to attend.
6. Attire / What to Bring
Please dress in comfortable sports attire. Please bring and wear a pair of non-slip socks during your class, for both safety and hygiene reasons. Non-slip socks are available for purchase at the Studio if required.
7. Class Schedule
Group classes: assigned instructors and respective class times/types are subject to change. The Studio will endeavour to give sufficient notice of any changes.
8. Health and Safety — Waiver, Disclosure & Assumption of Risk
Renew Physiotherapy & Pilates Sdn Bhd ("the Studio") offers group and private exercise-based classes, including Pilates, Barre, and GYROTONIC®, led by qualified instructors.
8.1 Client Disclosure
You agree to fully and accurately disclose any relevant medical conditions, injuries, surgeries, or physical limitations to your instructor before participating in any class, and to promptly inform the Studio of any changes to your health status. Where a condition requires medical clearance to exercise, you confirm you have obtained it before participating.
8.2 Assumption of Inherent Risk
You acknowledge that physical activity and exercise carry inherent risks — including but not limited to muscle strain, joint discomfort, fatigue, and aggravation of pre-existing conditions — some of which cannot be eliminated even with proper instruction and care. By participating, you accept these inherent risks as a normal part of group and private exercise classes.
8.3 Limitation, Not Waiver, of Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by the negligence of the Studio, its employees, or agents, or any liability that cannot be excluded under Malaysian law. Subject to this, the Studio's liability is limited to loss or damage arising from the inherent risks disclosed above, and not from a failure to exercise reasonable care in instruction or facility upkeep.
8.4 Property
The Studio is not responsible for loss or damage to personal property brought onto the premises, except where such loss or damage results from the Studio's negligence.
8.5 Scope
This section applies to group classes, private movement/exercise sessions, and use of Studio facilities. It does not apply to clinical physiotherapy treatment, which is separately governed by the Studio's Physiotherapy Informed Consent.
8.6 Photography, Video & Marketing Consent
From time to time, the Studio may take photographs or video recordings during classes, workshops, or events for use in its marketing materials, including its website, social media, and promotional content.
By attending the Studio's premises, classes, or events, you consent to being photographed or filmed for these purposes, and to the Studio using, reproducing, and publishing such images or footage without further compensation to you.
If you do not wish to be photographed or filmed, please inform the Studio in writing in advance, and we will take reasonable steps to exclude you from marketing content, or to obtain your separate consent before publishing any image or footage in which you are identifiable.
9. Privacy Policy
This section explains how Renew Physiotherapy & Pilates Sdn Bhd ("the Studio", "we") collects, uses, stores, and protects your personal data in accordance with Malaysia's Personal Data Protection Act 2010 ("PDPA").
9.1 Data We Collect
● Information you provide when registering, logging in, or booking classes;
● Correspondence you send us (email, WhatsApp, forms);
● Payment and credit purchase records;
● Class reservation and attendance history.
9.2 How We Use Your Information
● To provide and administer our classes and services, including bookings and payment processing;
● For internal purposes such as quality control, system administration, and service improvement;
● To notify you of changes to our services;
● To prepare internal reports for business and marketing planning;
● To comply with legal or regulatory obligations.
9.3 Retention
We retain your personal data only for as long as necessary to fulfil the purposes above, or as required by law, after which it is securely deleted or anonymised.
9.4 Disclosure to Third Parties
● Regulators or authorities, where legally required;
● Third-party service providers who support our operations (e.g. booking platforms, payment processors), under confidentiality obligations.
We do not sell your personal data to third parties.
9.5 Your Rights
Under the PDPA, you have the right to:
● Access the personal data we hold about you;
● Request correction of inaccurate data;
● Withdraw consent to processing (which may affect our ability to provide services);
● Limit or object to certain processing, subject to legal record-keeping obligations.

9.6 Data Security
We take reasonable technical and organisational measures to protect your personal data against unauthorised access, loss, or disclosure.
9.7 Data Breach Notification
In the event of a personal data breach that causes or is likely to cause significant harm to you, we will notify the Personal Data Protection Commissioner and, where required, notify you directly, within the timeframes prescribed under the Personal Data Protection Act 2010 (as amended) and its regulations.
9.8 Data Protection Officer
Where required under the Personal Data Protection Act 2010 (as amended), the Studio will appoint a Data Protection Officer. Contact details for data protection queries are set out in Section 9.5 above.
10. Limitation of Liability
Nothing in this section excludes or limits liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under Malaysian law.
Subject to the above, the Company, its contractors, employees, or agents shall not be responsible for claims, demands, injuries, damages, or actions arising from loss, damage, or theft to you or your property, save where such loss, damage, or theft arises from the Company's negligence.
Any guest of a user or temporary visitor to the Studio agrees to abide by the Studio's rules, and the same limitations of liability apply to them as to members.
11. Governing Law
These Terms and Conditions are governed by the laws of Malaysia, and any disputes arising from them shall be subject to the exclusive jurisdiction of the Malaysian courts.
12. Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms and Conditions, together with any separate consent forms signed by you (including the Studio's Physiotherapy Informed Consent, where applicable), constitute the entire agreement between you and the Studio in respect of your use of its premises, facilities, and services, and supersede all prior discussions, representations, or agreements on the subject.
14. Changes to Terms & Conditions
The Studio reserves the right to amend any of these Terms and Conditions at any time.
